Terms of Service
Welcome to UltraPod!
These Terms of Service ("Terms") constitute a legally binding agreement between you and the UltraPod Team ("we," "our," or "us") regarding your download, installation, and use of the UltraPod iOS application, website, and theme community (collectively, the "Service"). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By accessing or using the Service, you agree that you have read, understood, and agree to be bound by all the provisions of these Terms. If you do not agree, do not install or use the Service, and uninstall the companion app immediately.
2. License & Usage Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and run the UltraPod application on compatible iOS devices for personal, non-commercial purposes. You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the application;
- Modify, translate, adapt, or create derivative works of the Service;
- Use the Service to distribute malware, violate copyrights, or carry out any activities that breach local laws.
3. Third-Party Services & Content
The UltraPod application interacts with third-party software and platforms, including Apple Music, MusicKit, Apple Health/HealthKit, App Store purchases, and iOS system permission services. Your use of these platforms is subject to their respective terms and privacy frameworks. We do not assume liability for the availability, accuracy, or safety of third-party platforms.
4. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted operation or data persistence in the event of system updates, third-party service changes, revoked permissions, or unexpected app issues.
5. Theme Community and User Content
Browsing and anonymous reporting are available without an account. Sign in with Apple is required to like, get, upload, manage community content, synchronize blocked authors across devices, or associate a report with your account. Getting and uploading themes also requires an active Pro or Ultimate entitlement. Community themes themselves are free and are not classified by subscription tier.
You retain ownership of content you upload. You grant us a worldwide, non-exclusive, royalty-free, revocable license to host, scan, reproduce, resize screenshots, distribute, and display that content only as needed to operate and promote the theme community. You represent that you created the content or have all rights needed to upload it. Do not upload copyrighted images, trademarks, personal data, sexual or violent content, hate content, illegal material, malware, scripts, deceptive packages, or spam.
Uploads are scanned and reviewed before publication. Users can report themes and block authors. We may reject, remove, or preserve evidence of content; suspend uploads; or suspend or ban accounts when reasonably necessary for safety, rights enforcement, fraud prevention, or legal compliance. Review does not transfer responsibility for uploaded content to us. Copyright owners may contact Support with identification of the work, the reported theme, contact information, and a good-faith statement.
6. Theme Installation
A theme changes only compatible appearance settings selected by you. Unsupported fields and features unavailable under your current entitlement remain unchanged. Before applying a theme, the app shows differences from the current preset and lets you exclude individual changes. Themes may look different across app versions or devices. You are responsible for keeping a local preset or reverting changes when desired.
The Community website downloads a .upodtheme file only. It does not directly install, apply, or modify UltraPod. Importing and selectively applying a downloaded theme occurs inside the UltraPod app.
7. Governing Law & Dispute Resolution
These Terms and your relationship with us shall be governed by the laws of the People's Republic of China, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the court of competent jurisdiction where we are located for litigation.
8. Amendments to Terms
We reserve the right to amend these Terms at any time. The updated version will be effective immediately upon publication on this page and will replace the previous terms. Your continued use of the Service signifies your acceptance of the revised Terms.
